FOX 11’s “The X Factor Audition Pass” Contest

Who Can Enter

1.Contestants (including all members of a group) must be legal California residents who are 12 years of age or older as of March 1, 2011, who are legal U.S. citizens or eligible to work full time in the U.S., and who have lawful access to the Internet. Contestants must be 13 years old or older to submit their own entry online. Contestants who are 12 years old at the time of entry must have the parent or legal guardian of the contestant submit their entry online. Contestants or the parents or legal guardians of minor contestants must have a valid e-mail address.

2.Employees of Fox Television Stations, Inc., owner of television station KTTV, Fox Broadcasting Company, and Emmis Radio LLC, owner and operator of KPWR-FM (collectively, “Sponsor”), and Freemantle Media North America, Inc., their affiliated companies, advertising and promotion agencies, and the immediate family and household members of each are ineligible. How To Enter

3.NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST.

4.Only one entry per person. The contest begins when posted on March 14, 2011, and all entries must be received by 11:59 p.m. local time on March 20, 2011.

5.To enter, go to www.myfoxla.com and click on the link “FOX 11’s The X Factor Audition Pass Contest.” Follow all instructions to complete the online entry, including uploading an audition video of yourself singing one of the following songs a cappella:

(a.) “The Girl Can’t Help It”
(b.) “Give My Regards To Broadway”
(c.) “Greensleeves”, or
(d.) “This Little Light of Mine”.

The submission video must be no longer than 3 minutes. Video submissions that are over 3 minutes long, that use a song not on the above list, or that contain musical or vocal accompaniment will be automatically disqualified. Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, likenesses, and photographs for online posting, and/or any advertising and publicity without additional compensation.

6.All submissions must be original and conform to Sponsor’s then-current standards and practices and policies as established or determined by Sponsor in its sole discretion. Without limiting the foregoing, submissions may not contain profanity or references to violence, or demean any gender, race, religion or sexual orientation. Contestants must own the copyright to, or otherwise have all necessary rights in, their entry materials, except the song. Entry constitutes an unlimited perpetual license to Sponsor to use entry materials on its websites, television stations and in any and all media whether now known or hereinafter invented.

7.Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or technical, network, telephone equipment, electronic, computer, hardware, or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry, winner(s) or other contest information by Sponsor or contestants for any reason whatsoever. Sponsor is also not responsible for any injury or damage to any contestant’s or any other person’s computer related to or resulting from playing or downloading any materials in the contest or for entries that are late, misdirected or incomplete. All entry materials may be maintained as part of KTTV’s contest records. CAUTION: ANY ATTEMPT BY AN CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST IS A VIOLATION OF THE CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right to cancel or modify the contest if it becomes technically or otherwise corrupted.

8.Eight finalists will be selected on March 21, 2011. The submissions will be judged based on each contestant’s vocal skill and presence. Finalists will be notified by phone on or about March 21, 2011. The 8 finalists will then perform a song of their choice live for no longer than 1 minute on “Good Day L.A.” on or about March 23, 2011. A total of 4 winners will be selected by Sponsor and a panel of judges (to be selected by Sponsor). Finalists must perform live on “Good Day L.A.” on the date selected by Sponsor or they will be disqualified and an alternate finalist will be selected, if in Sponsor’s discretion time permits.

The Prize

9.The 4 winners will each receive an audition pass for the “The X Factor” Los Angeles auditions on March 27, 2011, at the L.A. Sports Arena in downtown Los Angeles. The prize has no retail value. The prize is provided by FOX Broadcasting Company. “The X Factor” auditions are subject to all rules and guidelines, including eligibility rules, as may be provided by “The X Factor” producers from time to time. Contestants acknowledge that KTTV and KPWR-FM have no control over those auditions.

10.The winners will be notified by phone on or about March 21, 2011. Groups must designate a member of the group to serve as the contact person for purposes of this contest. The winners (including all members of the group) will be required to complete, sign and return a Certification of Eligibility and Release and claim the prize in a manner determined by Sponsor in its sole discretion within 24 hours of the date of notification or they will be disqualified. If a prize is won by an eligible minor, then the winner's parent or guardian must also sign the minor’s Certification of Eligibil¬i¬ty and Release. If a winner cannot be reached, or if a winner (or any member of a group) does not return the signed and completed Certification of Eligibility and Release and claim the prize within the designated time period, that prize will be awarded to a runner up, if, in Sponsor’s reasonable discretion, time permits. Winners may be required to sign additional documents in connection with “The X Factor” audition process.

11.Prizes cannot be redeemed for cash or substituted for any other items by the winners. The winners cannot assign or transfer prize. Sponsor reserves the right to substitute a prize or to award no prize if the “The X-Factor” auditions are not held or if winners are ineligible for any reason.

12.The winners are responsible for all local, county, state, and federal taxes on prizes if any.

Odds of Winning Miscellaneous

13.Odds of winning depend on the number of entries received and the subjective judgment of the judges.

14.Except where prohibited by law, entry constitutes permission to use winners’ names, hometowns, likenesses, and photographs for broadcast, online posting, and/or any in any other media, including for advertising and publicity purposes, without additional compensation.

15.These contest rules are available at www.myfoxla.com, and Monday through Friday during normal business hours at KTTV, 1999 South Bundy Drive, Los Angeles, CA 90025 through March 20, 2011.

16.For a list of prize winners, send a separate, self-addressed, stamped envelope after March 25, 2011, but in no event later than one year following the end of the entry period, to: KTTV, 1999 South Bundy Drive, Los Angeles, CA 90025.

17.This contest is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsor is not responsible for typographical or other errors in the printing, offering, or administration of the contest, or in the announcement of the prize.

18.By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsor, its parent, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, and (c) to Sponsor’s use of contestants’ personal information as described in the Privacy Policy located at www.myfoxla.com.
